Abstract

The non-liability of adolescents as subjects responsible for committing crimes under our legislation has constituted a controversial debate from various angles, including the families of the alleged offenders themselves; and others, such as society itself, which is under attack from criminal groups that recruit minors to commit punishable acts. This investigative work aims to provide society with the legal elements necessary for a change in our legislation, understanding that the evolution of society implicitly entails regulatory changes. The lack of political maturity and the overflow of the capacity to execute actions by the entities charged with protecting our intrinsic rights is costing all Ecuadorians the impairment of protected legal rights. Given the constant declarations of internal armed conflict by the Constitutional President of Ecuador in an attempt to confront delinquency and high crime rates, we must ask ourselves the following question: Are we facing a failed state?
