Abstract

This research seeks to determine whether the independent peasant patrol can administer justice in Peru. To this end, using hypothetical, deductive, inductive, socio-historical, sociological, and hermeneutic methods, as well as documentary analysis and research techniques, we analyzed international and national norms, jurisprudence, and doctrine dealing with the exercise of jurisdictional functions and the actions of the patrols. It was demonstrated that the peasant patrol has a norm that is customary law, a geographical area of intervention such as a hamlet or populated center, with permanence and continuity over time, cultural values and institutionalized acts, recognition as an authority in society, and fulfills a social and jurisdictional function. Therefore, it can administer justice in rural areas of Peru.
