Abstract

The promise of purchase and sale is widely used in Brazil, with regard to real estate relations. This contract, which has as its object a definitive contract for the purchase and sale of real estate, has great effects, as demonstrated by the decisions of the Brazilian Superior Court of Justice (STJ). Therefore, the general objective of this research, based on bibliographies and documents, is to analyze how the jurisprudence of this superior court expands the legal protection of the promissory purchaser in light of the ineffectiveness of this type of contract. Specifically, this work seeks to describe and present how the doctrine and legislation work with preliminary contracts and promises to purchase and sell real estate, highlighting their legal implications, especially for the buyer, as well as to analyze the actions of the STJ, highlighting the demands and how it extends the legal protection of the buyer. Therefore, we conclude that the STJ plays a fundamental role in the legal protection of the promissory purchaser of real estate.
